    Default Accused of Shoplifting but Not Charged, Banned from Store

    My question involves criminal law for the state of: Texas

    My daughter and Son n law were accused of shoplifting from a major retailer, nothing was found on them, they were not searched or charged but police were called.
    They had to sign something and were banned from from this and all stores in this chain, major retailer.
    They were told the stores attorney would be sending them something to sign.
    They have been falsely accused, and humiliated and shamed with this retailer having no proof and nothing found not paid for.
    Do they need a attorney, and what about this paper they signed.
    They should not answer attorney questions form retiler without consulting attorney?
    Can they just accuse people and humiliate them, ruin their lives without any proof?

    What about "the paper they signed"? Was it a confession? Acceptance of the ban? Both? Something else? How have their lives been ruined?

    If they receive a civil demand, they have the right to decline to pay it and see if the store tries to sue them.

    I think it is acceptance of the ban, and alot of legal mumbo jumbo, and maybe their lives were not ruined but it is pretty damaging to some one to be treated as a criminal without proof.
    All this was done in front of my five yr old grandson, so maybe ruined lives is a wrong estimate, but this is somethig that was done without any proof.
    Now My grandson is confused and can't undertand why they can't go back to walmart.

    Without knowing what they signed, it's hard to tell them it's significance. If they are in fact innocent, they may be able to get somebody higher up in the corporation to review the case (and videos) to see if the accusation was justifiable. It's also possible to convince a retailer to lift a ban, typically a year or more after the incident, although that can't be guaranteed.

    Something's not adding up here. My brother's father-in-law is an LP for Walmart and I know for a fact they don't stop you unless they have solid proof of theft. Walmart LP will get fired for stopping someone who doesn't have the goods upon exit even if they witnessed concealment. Are you sure your son and DIL are being honest with you?

    If, in fact, they weren't shoplifting, then go after Walmart and get the LP fired.
