    Default K1 After Entry Denied

    Hello , i would love someone to help me , this is my case :

    I m from Spain , Madrid . In the month of June 2007 i first land in NYC to take attendance in the film academy , after 5 months , days before that my visa F1 expired i enrolled in an English school what gave me another 5 months period , days before the expiration of the second Visa i traveled during two weeks out the US , comming back as a visitor/tourist after this two weeks and staying in the States for another 90 days period , after that i went back to Spain for a month . After a Month in Spain i went back to the US staying for a 91 days period using again the Visa Waiver Program .

    I went back to Spain where i stayied for a 5 months period , then i tried to go back to NYC . I booked a ticket Spain-NYC with a conection in Philadelphia airport ,in where i was stopped and interrogated . The reason was the day overstay in my last stay as a Visa Waiver Program . I answered that i dindnt know about the one day overstay , it was an accidental mistake doing the maths with the 90 days period . But the officiers went through my luggage and all my personal items , where they found a bussines cards with my personal info , including a NYC address and US cel number , in the cards appear the inscription Photographer below my name , also a website address with photograps .
    They understood that as a Prof of my ilegal work in the Us .

    Then i was send back to Spain . In Spain i went to the Embbassy to try to solve the problem and getting a new visa but i was refused .

    Now more than 6 months after all this incident my question is :What do i have to do to get married with my girlfriend who is an american cityzen to be able to get a K1 Visa , and there is option besides marriage???

    No easy answer. They found out that you were working illegally in the U.S. - the one day overstay isn't such a big deal of itself, beyond disqualifying you for visa waiver, but the unauthorized employment could very much complicate your future immigration efforts. The body of your post doesn't mention a visa denial, but the subject does - if you've already been denied the K1, I suggest consulting an immigration lawyer about your options. I assume an INA or CFR number was annotated in your passport when you were denied entry - can you share that information?

    If your fiancee were to obtain a K1 for you, you would have to marry within 90 days of your entry into the United States. There's no version of a K1 that doesn't involve marriage.

    Because of the issues you have had, I would recommend an Immigration Attorney.

    Please also see my post about K-1 Visa's. I went through the process bringing my guy over from Canada, and described the process.

    With a K-1, you have 90 days to marry, from the day you enter the U.S. You then have to go to the USCIS office and show a copy of the marriage document, set up an appointment for fingerprinting, and an appointment for an interview.
