My question involves criminal law for the state of: NJ
My cosigner for my student loan is suing me saying that she never agreed to the loan, and what she did agree to was to be a "reference" and that too for one-fifth of the amount of what the loan was applied for.
The cosigner makes six figures and she has a very good lawyer while I am unemployed and can hardly maintain four figures in my bank account. Basically what I'm trying to say is, that she has the resources to pursue this, which I don't.
The cosigner is also playing the victim card since she is a single parent and was going through a rough divorce when the loan was applied for. She claims her state of mind was unstable, and since we were living in the same house, I stole her information and signed on her behalf.
She wants me to pay off the loan immediately, something which isnt impossible for me but very very very hard. I have no idea how law, etc procedures work. Can the court check that the signatures are actually hers? If I have eye witnesses who would testify that she actually DID agree to the loan, will it help? Please advise.
