    Default Other Person Wants Claim One and a Half Month Later

    Okay, so here's the deal. This is based on what my mom told me since it was her car. My mom hit the car in front of her, she hit the towing ball thing that pickup trucks have. Sorry, I don't know the specific name. My mom's car front bumper was cracked, but it never touched the other person's back bumper, just the tow ball. The other person said it's okay since he didn't sustain any damage and both parties left without sharing any information.

    Then today we receive a letter from a lawyer stating that they tried to ascertain our insurance coverage. If we don't give them our information, then they will take it to court.

    Now, this happened a month and a half ago. My insurance company said no one filed a claim or tried to. So I don't get it, what is this person trying to get? This just doesn't make sense, I would think that if a person was trying to get a claim that they would notify us within the first week, not a month and a half later.

    So should I call my insurance company and tell them about this issue or should I just hire a lawyer?

    Call your insurance company immediately and give them the information, including the contact information for the attorney who contacted you. You shouldn't need your own attorney unless your insurance company tells you that they won't cover you since the accident wasn't reported in a timely matter (depends on your policy).

    You ask, what is the person trying to get? Well, absent any damage to his vehicle, I would assume that he is after money claiming real or fabricated injury which necessitated medical treatment.

    So I just file a claim with the insurance company and tell them everything? Sorry, I'm a newb at this and don't know if it's a claim I'm going to tell them about.

    You are going to give them an accident report and the fact that you have been contacted by an attorney for the other party. You probably have a phone number on your insurance card to call to report an accident. If not, there should be one that says "claims". If not there, look at your policy or call your agent. Yes, it would be their claims department that will handle it. They'll probably want a copy of the letter you received from the attorney. Don't reply to it. If the attorney or anyone representing the other party contact you do not talk to them. Let your insurance company handle it.

    I contacted the insurance company and gave them all the information that I could based off of what my mother told me. The rep. told me that to contact that law firm and give them the claim number, and that they will only be talking to the insurance company on this matter from now on. Now, I just have to wait till Monday to tell them.

    Thanks for the info. I just didn't know if I had to file a claim about this or hire a lawyer. +1 on learning something that I now know for the future.
