    Unhappy Affected by Ex's Default Despite Protections in Divorce Judgment

    My question involves an auto loan or repossession in the State of: MA

    When my divorce was final it was agreed upon that my xhusband kept the vehicle that i co-signed for. In our divorce agreement it clearly states that he is to retain this vehicle and be soley responsible for all expenses including the loan payments and that he holds me harmless from any and all costs related to said motor vehicle. Well with only a year left on the loan he has let it go and the car has gone into repossesion and they are looking for it, I have no idea where it is, as he cut all contact with me. But my credit is now getting trashed when I thought I was covered with this in our divorce agreement! What do I have to do to get the bank to correct this? or can I????

    Since you co-signed the loan, you are going to have to make payments/pay off the vehicle to protect your credit. You can then try suing your ex husband to get your money back since the divorce decree noted he was to make payments. (if you can locate him) The bank though doesn't care about the divorce decree - they just know & care that you are a co-signer on the loan.

    Thanks for the response, so looks like having that in the divorce agreement was pointless.....

    In regard to co-signing the loan - "in a sense" though you can try to get your money back as per the divorce decree.
