I was divorced in August, and it went to trial before a family court commissioner in Missouri. He awarded my ex $23,744 as a marital property equilization. He awarded me the home, and my 401K. I was given 60 days to secure financing for the settlement, and I feel that I have done that. My attorney said they can amend the judgment for my ex to get the 401K, and I wanted to do a QDRO, to get her $15,000 (It would have an immediate 20% tax), which I will pay, leaving about $12,000. I can get the remainder from my bank through a loan, and my judgment is satisfied. I told my ex's attorney how I could pay this, and she told him she wasn't interested. She wants cash, and is not interseted in the QDRO. I think she is worried about having to claim the money as income. There is no stipulations in the decree as to how I am to pay this settlement, and I am not responsible for her income taxes. I feel that she is wanting to play hardball, so I can to. I want to pay her $100.00 a month for the next 20 + years. Can I do this without problems?
