My question involves criminal law for the state of: CA
My 27 year old daughter got a DUI. It was her first offense, and she has a clean driving record. She was arrested in the evening, around 9:30pm, with no passengers in the car. We haven't gotten the BAC reading yet, but paperwork says she cited for DUI + DUI with BAC > 0.08%. She had 2 drinks over the course of 2 hours. Local police (not CHP) pulled her over on the freeway saying she was driving erratically. They also said she failed the Field Sobriety Tests.
In any case, I was hoping someone who's been in or knows someone who's been in this situation can provide some advice. The first question I had was should I hire an attorney? An attorney is a good idea, but I presume the costs will be several thousand. I was just wondering if the outcome would be much different with or without an attorney.
License Suspension? Is there any possibility of NOT getting her license suspended?
Jail time? Is there any chance she'll get jail time? There were no injuries and she was alone in the car.
