    Exclamation To Anyone Receiving UI Thinking of Part Time Work, Think Again

    Please heed this warning!!

    I was receiving UI compensation at the rate of 450 a week in California after being laid off from my teaching job. After a couple months of looking for a similar position I decided to swallow my pride and take a low paying job, mostly just to keep busy. I reported my wages on my claim forms and received partial benefit...fine. I was on my second extension.

    A couple months after I began my part time job I received in the mail a new claim (which I never filed) with an adjusted compensation rate of $80.00 a week and a total benefit amount of just over 1000 dollars. What??!! Because I decided to get off my ass and take whatever job I could find, I was penalized...big time.

    Now my $80.00 a week claim is exhausted and I am 300 dollars shy of getting an extension on that claim. Also, I just got laid off from my second (part-time just want to be a productive member of society) job. I'm wondering now how I am going to survive. It's terrifying.

    If I had decided not to work I would have been able to complete my second extension, and would now be eligible for Fed-Ed receiving 20 additional weeks at $450.00

    So please people....if you have high UI compensation, don't even bother with part time or lower paying jobs.

    EDD is twisted. They punish those of us who choose to contribute to society and find whatever work we can.

    It's not only California, it's any state. I will be in the same position at some point if this temporary gig doesn't go permanent next year.

    Having said that, you can also lose benefits if you refuse to accept a "reasonable" job offer. Unfortunately, what states considerable "reasonable" is often, "are you kidding me?".

    I sorry to hear you are in this position too. I think there should be safeguards against things like this. Before I was laid off from my original job I was making just over 50k a year. The job I accepted as part time work paid 12 dollars an hour. I honestly only took the part time job because I actually enjoy working (I think it's good for ya) and couldn't find anything else.

    Now I am left with nothing....ZERO! The way the system is set up it actually encourages people to not look for jobs. Had I known, I would have bought an X-box instead and had myself a nice little vacay.

    Good luck to you, Patty. I'm thinking of appealing the decision, although doubt it will help.

    In Ohio, if you've been collecting benefits for more than a few weeks, they drag you in for mandatory "job retraining education", where they will talk down to you and treat you like a moron, and make damned certain that you remain miserable as long as you're collecting UI. If you don't give the impression that you're looking for work all day, every day, seven days a week, they'll yank your benefits.

    In spite of that, I still managed to learn to knit and raise a bitchin' veggie garden the last time I was collecting UI.

    Now I'm self-employed.

    Yep, I'm actually losing money by working. My benefits are XX per week. My net pay, 40 hours per week, is now (after a $1/hr raise after 90 days, that my agency had to push for) is XX plus $30. Which is more than eaten up by gas, car maintenance, that kind of stuff. If I wasn't working, I would qualify for up to 59 weeks (with all the extensions) at max benefit. The logic of all this escapes me.

    You mentioned you were on your second extension. I bet if you look at the start date of the claim that is paying 80 per week, it started on 10/4/09 or later. that is becuase if the benefit year on your extension expired, you have to "test" for a new claim with the quarters change. You probably were eligible on a regular claim that only paid 80 dollars per week based on what you earned during the quarters of time they are looking at. Has nothing to do with you working part time. Just a guess.

    I believe that you are correct - at least in California and probably in most or all states. But, the way to manage this is how you apply for a job. If you are truly looking for full time work, apply only for full time work (one of the fields on most applications). Make the required weekly contacts for work that makes sense for you. The only companies that know you are looking for work are the ones you apply to. Instead of applying for a low-paying part time job "mostly just to keep busy", use that time to do what you need to do to persue a better job. Walmart and McDonalds (as examples) are not going to come to you unsolicited and offer you a minimum wage job.

    Apply only for jobs that make sense for you, and do the legwork so you make enough contacts each week, and you won't have a problem.
