    Default Burglary/Theft Charges

    My question involves criminal law for the state of: Pennsylvania

    I am being charged with burglary and theft, and I did not commit the crime. I know who did but the person who did is the one that told the police that I did this. His statement is the only evidence that they have against me, and he has a record of stealing the exact same thing. He has a long record, all theft. But they are believing him...he is also on probation and this would have been his third strike. What can I do to prove I this? The police came and questioned me about the crimes that had been committed and I told them everything I new at the time. They came to be because the stolen items had been sold in my name, he told me that it was his and he needed the money and didnt have his ID. I trusted him and didn't think anything of it, I told the police all of this and offered to write a statement, but was told not to. After speaking to the police about this I went to the guy and asked him to tell me the truth, was it stolen? and he admitted to me that it was, I am scared to even tell the cops this because they already want me in jail. How can I prove this. I do not have any kind of a criminal record or past run ins with the police. I'm scared they won't listen and will just put me in jail. I honestly think that the guy became an informant for them and that is how he is getting out of this and why they are believing him. How can I fight this? please any help you can give would be greatly appreciated!!!

    Consult legal counsel immediately. When you have spoken to an attorney, he can help you devise a way of casting doubt on the accuser's story. If he is a big thief, and you are upstanding, then it should take little effort to cast doubt on the man's credibility - especially if an alternate theory can be made to show that he benefits from the tale.

    I would recommend you do nothing more until you speak with an attorney.

    would an attorney call the police to tell them where I am, a warrent was issued for me without the investigator even trying to talk to me first, he had my phone number and didn't call, he told my boyfriends parents but we hadn't seen them, and he stopped there twice and after that he said he was issuing the warrent because he couldn't "find me" But he never even called my phone. If eh would have I would have gladly talked to him. This is the reason that I am scared to go in. I want to talk to an attorney but I need to make sure I can get my mother guardianship before I do turn myself in. how should I go about this?

    I cannot speak as to the specifics of the law in your state, but if you work with an attorney he can help arrange for you to turn yourself in. He is unlikely to call the cops to report where you are, but neither can he actively conceal you.

    Speak to an attorney before this carries too far down the road.
