    Default Switching from Salaried Non Exempt to Hourly

    My question involves employment and labor law for the state of: Virginia

    My employer recently decided to switch all salaried non exempt to hourly. They will pay overtime, however they have this tightly regulated and usually do not approve it. Salaried employees were eligible for sick time and extra vacation time and STD paid at 100%. Hourly employees have to use PTO and are only paid at 70% for STD after using a week's worth of PTO. My question is if there is restitution for the lost sick time and vacation time for making the switch? What is the point of being hourly when they won't pay you overtime?

    No, there is not.

    Although it doesn't make a difference to the answer, are you sure benefits are "salaried" and "hourly", not "exempt" and "nonexempt"? Salaried and hourly are merely pay methods.
