    Unhappy Being Sued Over a Traffic Accident That Occurred Five Years Ago

    My question involves a traffic accident in the State of Missouri
    5 years ago i was in a car accident, which i received a failure to yeild ticket. to my defense i feel that both parties are at fault. i was on side street pulled up to the stop sign, stopped and looked both ways then preceeded to make a left turn onto the road. The road that i am turning onto is curvy, hilly road. The view to my left has a blind spot due to the fact there is a small hill with enough of grade that you cant see a car coming until tops the hill, which is about ten feet from the stop sign. So as i am making my turn, i see no car until she tops and i am already in the road. She then smacks directly into the front quarter panel of my car totally smashing the wheel and the axle, not drivable. The speed limit for this particular road is 25 mph, she was every bit going of at least 40 , but would not admit it to the police that she was. Also it had been rainy that day and the road was wet. In the police report the officer asked us both if were hurt. We both were shook up and complained of minor injuries. However refused treatment at the scene. we exchanged insurance info and went home. I was shocked to find out later that day that my insurance had cancelled me two days prior to the wreck. She is now claiming bruises,contusions,lacerations,sprains and strains of head,neck,back,shouldersarms,legs. Loss of income has to pay and will continue to for medical csre and drugs! Damages in the amount of 19,843.50. I received the summons to court 3 days ago, court date is Nov. 25, 2009. I believe that the statue of limitation runs out Nov. 18 ,2009. Can you give any advice vice as to any hope for my defense? Thank you

    the statute of limitations stopped running the day she filed suit.

    I don't really see any defense for you and the fact you did not have insurance means it comes out of your pocket.

    without intent of giving hope, why was the insurance cancelled and did they notify you of their intent to cancel the insurance prior to the cancellation?
