My question involves unemployment benefits for the state of: IL
My husband was terminated from his job on October 8th. The reason his employer gave at that time was political reasons, and someone from the corporate office believed him to be "pencil-whipping" numbers. He was never given a termination letter stating the exact reason he was fired, and there was another employee in the room with him and his direct boss that heard these reasons.
He came home, and immediately filed for unemployment benefits. Yesterday he had his phone interview with the unemployment office and explained his side of the story, which is this: He was a merchandising manager. One of his weekly duties was to do an electronics inventory and turn it into his general manager, who was supposed to make the changes in the computer. Around 6 weeks ago, the entire management team at his store was written up because all of the entire store inventories had not been going well. The company hired an outside firm to do an inventory every quarter, and those inventories were the ones that were in the computer and believed to be correct. He had found several errors in the numbers from those inventories, and marked them every week on his electronics inventories to be fixed by the general manager. Somehow, for six weeks, he accidentally overlooked the fact that the inventory company had marked three small televisions when in fact there were none in the store. He fully acknowledges this mistake. After the management team write-up, he had asked for and been promised more help with his duties, as they were enormous and he needed the help. He never received any. An hour before he left for the day on the day before he was terminated, he was informed about the televisions. His company would not allow him overtime to search for the reasons behind the error or try to fix it. Before he clocked in on the day of termination, his boss took him aside and told him he was fired. He was given no chance to fix the mistake.
The Unemployment office called back today and told him that she had spoken to the corporate office and they say that the reason for his termination was "falsifying documents" regarding the inventories. He was never told this was the reason he was fired, and frankly, it is not true. They have the inventories he did that have other mistakes pointed out, he just somehow missed the three televisions. As they were in a back room that was kept locked with all of the other electronics in the store, he says while doing his weekly inventories, he would go into the room and count as quickly as he could, as he was so busy and not receiving the help he asked for. It was a mistake that he fully admits to, and thinks if he had the help he had been promised he would have noticed the mistake earlier.
The unemployment office is calling the corporate office of his company again, and then will be making their decision. If he is denied benefits, is there a strong reason to appeal?
