    Post Switch from Salary to Hourly Delays Pay One Week

    My question involves employment and labor law for the state of: Missouri

    My employer recently decided that most of the exempt employees didn't really qualify for exemption. They switched us all to hourly effective in the begining of november and will short one of our biweekly checks for one week. They say that they must do this because as exempt employees we were paid for the two weeks we worked at the end of that two weeks, but since they have to tally the hours now, the payement will be delayed for one week. This really hurts. I feel like I am being shorted for a weeks worth of pay but they say that it doesn't matter because we are still being paid for it, just a week late now. So one of our biweekly checks will be half what it is normally. Is this legal?

    Yes, it is legal. Nor is there any law in your state requiring a specific number of days notice for a change such as this. This change could have legally been made even if you hadn't been changed from exempt salaried to hourly nonexempt. In fact, it's a payroll best practice to pay ALL employees in arrears, not just nonexempt employees.

    You are not being shorted a week of pay. You are just being paid one week AFTER the pay period ends instead of the same DAY the pay period ends. The pay period remains the same.
