    Default Alcohol in City Park, California

    My question involves criminal law for the state of: California

    My friends and I were sitting at a park drinking beer when a cop came up to us and ticketed us. The ticket said its a misdemeanor. I'm of legal drinking age by the way.

    Fountain Valley Municipal Code 12.08.080

    Is there any way I can lower the charge to an infraction? How would I do that? And what are the penalties? Thanks.

    You can contact the prosecutor, or hire a lawyer to do so, to try to negotiate a reduction of the charge from a misdemeanor to an infraction. The maximum penalty as charged is a fine of up to $500 and/or up to six months in jail. If your record is clean jail's not likely. The total fine can exceed $500 due to additional court assessments.
