    Default Shoplifting at Marshalls

    My question involves criminal law for the state of: California

    Hi. my name is Diana and i am 28 yrs old. i was caught shoplifting with a $10
    shirt a Marshalls. the LP guy took me to the security room, filled out two papers. one is my info using my driver license and last 4 # of my social. the other one is a notice that they had detained me for shopliftin at their store. i signed both papers. no cops involvement. i wasnt arrested. they let me go in 10 minutes. i was shaking, scared, and i've been crying every day. this happened 2 days ago. i had made the biggest mistake of my life. ive been praying to God for forgiveness. i dont know wat to do. what will happen to me? will i get arrested later on? do i have to go to court? will it stay on my record for life? can i clear or seal the record later on? im in the process of applying for a job that requires state license. any inputs would be appreciated. i've keeping it inside me and i feel soo hurt. i dont know wat will happen. i just want to kill myself right now...thank you very much you guys.     Please, do dial back the drama. At 28, I'm sure you're aware that "I want to kill myself" is silly teenage hyperbole that only makes you look foolish. Knock it off.

    If no police were involved, then you have no criminal record and no court.

    What you have is the possibility of a civil demand. This is, in essence, restitution to the store for both the merchandise you stole and the time and money it cost the store to have LP drag you off to the office to recover the merchandise.

    When it shows up, pay it. It's going to be a tidy chunk - $100 or more. If you don't pay it, you risk criminal prosecution for the initial theft, plus damages.

    Hi Diana,

    There is a lot of information in the stickied threads.

    There's a possibility of being put on a National Retail Theft Database. No one knows (or tells) which stores participate. So yes, it can show up in certain background checks.

    I had police involved in my case. I also had a lawyer. First time offender, so I was given a plea deal of "Disorderly Person".

    As for a job involving a State License: I just posted a few days ago about my case. I applied for a Florida Real Estate Salesperson license. I had to go through a few extra hurdles, but I was approved. Those extra hurdles included getting a Certified Copy of Judgment ($11, at the courthouse), and copies of the paperwork I had. I also had to get atleast 3 Letters of Recommendation (I went with 5). Remember, the above was my case, and I don't know what California will do.

    thank you for your response guys. im just really scared right now. I've learned that the store can always press charges against me. im not just myself for the last two days.

    my other question is when will i be expecting a civil demand letter from them? what if the mail gets lost?

    No, the store cannot "always" press charges. They've only got a year.

    If you pay the civil demand timely, they won't usually bother.

    The civil demand won't get lost. Those usually get sent Certified. It could take a couple weeks, it could take a couple months. It simply depends on how backed up their Loss Recovery department is.

    Thank you for your advice as well as for all of you on this forum. i cant thank guys enough. my problem now is that im in the process of moving and the store have my old address. i will be moving in to my new address soon. Should i contact the LP agent or the loss prevention office to update my mailing adress. im afraid that they might think i lied to them when i gave them my old address. What should i do? Thank you once again.
