    Default B&P 25620(a)

    My question involves criminal law for the state of: California

    I live in tight alleyways in mission beach san diego. I have a large front yard, my friend and I were leaving to go to a bar down the street and i took a step out of my front yard into the access alleyway. It was very dark, there is no lights in my alleyway and I picked up a beer that was on my fence to finish it before i left, and get it off my fence. Two cops were hiding in the alley way and ran over to me, i put my beer down and without any thing being said I was pushed into the fense of my neighbors house, my hands forced behind my back and I was searched ( pokets turned inside out) from head to toe. Nothing was found and the cop wrote me a ticket 25620 (a). The ticket says there was 1/4 left in the beer, which is an exagerration. Is there any way I can fight this? Is everything legal here? Also, the cop told me If I take it to court he will probly be riding his dirtbike in the dunes...

    Of course you can fight it ... but, what is your defense?

    Yes, if San Diego still has an open container law, then the contact and the citation were proper. The search of your person was likely done incident to arrest. You were released with a citation to appear in court for B&P 25620.

    I suspect that the officer might have meant that either the overtime woul dpay for his vacation, or, that he would not make it to court because he'd be gone on vacation or days off. Not sure what he inferred by the comment.
