My question involves a roommate in the State of: TEXAS
In March of this year, I had a friend that was in need of a roomate for a 4br house, She previously had a roomate that was on the lease and she had problems with and she was asked to leave, she did move and there was a vacancy, she asked me to move in as well as another girlfriend, I have two little boys, so the rent was split and I was added to the lease and the other young lady never added herself. The other friend decided to move her boyfriend in and not let anyone know, so she ended up moving out with out paying rent nor utilities. We had to pay additional rent and utilities. We ended up not getting another roomate, however, my roomate decided to begin letting her boyfriend live there for a total of 5 months rent free. This posed an issue for me as I have children and I am not ok with his lifestyle. Things got a little ugly and I basically told her I was moving out, she had lost her job back in may and was living on unemployment, not contributing to groceries nor items for the upkeep of the house, The land lord said since she didnt have a job he was ok with us moving out and not making us pay any extra ( The deposit was left when she originally rented the house in Dec with the previous tennant and I was never asked to leave a deposit it was covered before my signing the lease) She lent me a dresser drawer set which she demanded back asap, when I was taking it out of my room one of the drawers broke, she claimed that I broke it purposely and she was suing me. She sent me a message asking if another guy could move in for the month of oct to help with the rent since we were leaving in nov, I said I didnt care as I wasnt staying there hardly, when rent was due the guy backed out and I only made arrangments to pay that portion. The landlord said that as long as I moved my stuff out before the 16th he wouldnt make anyone pay that extra, she moved all of her items out on the 14th. My son made a hole in the wall which he is charging to her deposit which she said she is suing me for these damages. If I was never previously asked to leave a deposit can she do this? She is also suing me for utilities when all of the utilities were under her name, I rarley stayed there, and she disconnected them all on the 12th of OCtober with no notice. She is also stating that she is suing me for her dresser for a total of 175.00 when I have the ad she posted on craigslist to sell it for only 50. She says its damaged when there is no visible damage to the thing. Can this be done? She has sent me a certified letter. This is all the action that has taken place so far.
