    Default Patronizing with Prostitute Charges

I been charged with patronizing with a prostitute(in WA state) and prosicutors are not willing to dismiss the case. So my lawyer recomended for bench trail some time next month.

First of all, I was very hesitant and drove away from the scene and here's the key information from the undercover cop's case report:

"...I asked [my name] if he was looking for a date and he said yes and asked if I had a room. I told him that I have a room at the "[hotel name]". He asked what I do and I told him "anything" and asked him what he wanted, head or sex. He said that he wanted "full service" and asked me how much. I told him $60 and he told me he only had $40. I said, "OK, $40 for full service?" He said yes so I told him to pull behind Shucks. He was very hesitant and did not wanted to drive behind the building, asking me to get in the car where it was currently at. I said that I couldn't and started walking toward the back of Shucks.
As I was walking away from his vehicle, I gave the "good deal" signal....."

The bottom line is that I was bargaining, discussing, posturing and then not interested in sex and a “deal” was never struck. That’s why you drove away. Is No deal = No crime?...What are the chances that this case be dismissed on a bench trial?

    Thanks,

    -R

You inquired enough that any reasonable person would believe that you were wanting sex. If what the undercover cop says is true, it does sound as if you solicited. When you admitted you were looking for a date, is when you broke the law. The rest was just gravy.

The chance that the prosecutor will drop the charge, slim to none. The chance the judge will dismiss. We don't know, our crystal ball quit working. You have already done what you needed to do, and that was get an attorney. Now take his advice.

I think you could of had somewhat of a shot if you just asked about a date and hotel, once you bought up money and negoatied that amount a person can reasonable assume what you were after. Maybe ask your lawyer if the charge can be reduced to something not as bad.

But I drove away from the scene and was pulled over on the highway. If I were wanting sex, I would have gone to the hotel room with her but I didnt. Does that give any chance of getting case dismissed by a judge?

You were wanting sex and you just couldn't agree on a price, that is why you drove away, is what the jury will hear.
