My question involves a child custody case from the State of: ohio
My brother recntly gained full custody of his 5 yo daughter after her mother didn't bother picking her up for a year (they had court ordered shared parenting.) Mom has one day/week and every other weekend visitation, which is not going well. Dad may have won the case, but the kid has actually been living with grandma and grandpa all this time. Mom has other kids, and children services have been involved in her home at least twice. Grandparents are at their witts end with the child. My husband and I have stable jobs and a 15month daughter ourselves. We could easily covince my brother that giving us guardianship of her is her best option to have a happy healthy childhood, but I'm not sure her mother would agree. How do we even go about filing for guardianship? We would even be willing to let mother keep her visitation, as long as she followed it to the letter (ie bringing her to school on her day, whether she felt like getting up or not, with a lunch).
