    Default North Carolina Equitable Distribution First, then Custody Agreement

    My question involves divorce in the State of: NC

    Howdy,

    Strategically it would be beneficial for me to get my wife to sign a separation agreement address Equitable Distribution first and then hammer out custody agreement.

    Can I/we sign this separately and do this without the custody agreement later affecting the ED?

    You can enter into an agreement governing the division of the marital estate apart from entering into an agreement or court order pertaining to custody.
