    Default Forced Out of My Job

    My question involves labor and employment law for the state of: CA

    Almost a year ago a new manager was transfered into a management position that I was promised. The promise was a verbal promise. The woman is 29 years younger than me. She has a bachelor's degree and little experience. I have an associate's degree and many years of experience. She is very attractive and I am obese. We work in a hospitality environment.

    The new manager made many mistakes. I tried to teach and help her. She began to point out her errors to our boss as my errors. I tried to protect myself and email her with a cc to our boss regarding errors made and whose fault they were. I was never mean about it; just informative. That made her mad and she set in motion a moustrap that put me in humiliating position of bad employee...getting written up over things she had done. She had documented everything to give herself the evidence she needed to show the bosses how wonderful she is and how bad I was. Last week I met with my manager and tried to reason with her and "make friends". She told me that she had done everything in retaliation for all I had done against her. The things I had "done against her" were simply self preservation. She got the bosses to believe her and make me look like a bad employee just making excuses for errors. When I was ambushed last Friday by her, her boss and an HR rep - more accusations were hurled at me. I gave my notice of resignation. HR told me that they accepted my reignation and notice. They would not fight my EDD claim and nobody would give any bad references when I sought other employement.

    I left defeated. That young woman used bald faced lies to get me out of the office. I am a naive woman who believed that if I work hard and play nice, I will be rewarded. How wrong I was.

    Do I have any lawsuit here?

    I don't see anything illegal about how you were treated. In addition when you file for unemployment and say you chose to resign you are automatically not eligible to receive benefits - they don't need to fight your claim. When your employer agrees with you that you resigned your position your claim will be denied.
