You're speaking about the transfer of probation for somebody whose probation has already been retroactively modified by NRS 213.1243, or about somebody whose probation was transferred prior to the modification of probation? I don't care much for the defendant's chances either way, but I doubt that you have a leg to stand on in the first context.
