My question involves criminal law for the state of: illinois A guy at my house was told to leave and he physically kept me from getting into my house by pulling on my arms and legs. When I kicked him off me I threw a piece of junk at him that he deflected with his hands. I tried to get in my door and he pulled me outside again, punched me, knocked off my glasses and finally left. His knuckle was bleeding. Glasses were lost but he admitted a couple weeks later that he took them and threw them. I wanted to press theft charges, but the cop said I waited too long (2 weeks, since we finally had proof he took them) to report so he would arrest us both for assault and the other guy for theft. I'm on probation so I didn't want to get arrested, but now 2 months later the guy is filing complaints against my wife at work to get her in trouble since we are planning to sue in small claims for the glasses. Q:Is it too late to go ahead and press criminal charges against him for assault and theft? Can a different cop decide to not press assault charges and theft only? Will probation be revoked if I'm arrested or only if found guilty? What are the chances of beating an assault charge for me?
