    Default Standing mute in court

    hi...this is what i read---a post by aaron:
    "There's no practical difference any more. Some people feel more comfortable standing mute, if they intend to later enter into a plea bargain or plead guilty"

    so in other words, does this mean you cant enter into a plea bargain if you simply say not guilty?

    also, when you stand mute do u reply 'stand mute' or just say nothing when the judge asks how do you plea?

    There is no practical difference. You can enter a plea bargain whether you stand mute or plead not guilty.

    It is easier on the court if, when asked for a plea, the defendant answers "I stand mute". Although a defendant who literally stood mute might make court proceedings a bit more amusing for court spectators, at least for a few moments.

    Amusing right up to the point the judge smacks you for contempt if you don't answer him.

    When you stand mute the judge automatically enters a plea of not guilty. At this point there is no difference between standing mute and pleading not guilty. I don't see the stratigic reason for standing mute.
