    Default How to Change Biological Father on Child's Birth Certificate

    My question involves paternity law for the State of: Maryland

    I was married to Husband A at the time of my son’s birth. Husband A is listed as the father on my son’s birth certificate but he is not my son’s biological father. Husband A and I have been divorced for 8 years now. Husband B is the biological father of my son. What do I need to do to list Husband B as the father on my son’s birth certificate? Is it as easy as completing an Affidavit of Parentage, getting it notarized and submitted to the Division of Vital Records? (By the way, my son was born in Maryland and we now live in Virginia.)

    My son is 13 and this is long over due!

    Are you stating that your ex-husband, the child's legal father, wants to give up his parental rights?

    I was married to Husband A when my son was born. He is not the biological father. But he is on the birth certificate. I am now married to Husband B. He is the biological father and we want him to be identified as the birth father on my son's birth certificate.

    Right. So again, are you stating that the child's legal father wants to give up his parental rights?

    I suppose so. We were under the assumption that he has no rights since he is not the biological father. He has never operated as though he has parental rights and has not been in my son's life since we separated when my son was 1 year old.

    I thought it would be as easy as the biological father claiming parentage which would, in essence, "revoke" any assumed rights.
