    Default I130, Question 16, Marriage

    "Has your relative ever been under immigration proceedings?
    No_ Yes_ Where______ When_____

    Removal __ Exclusion/Deportation__ Rescission__ Judicial Proceedings__"

    I came to the States in 2002 on B2 visitor. It already expired and got a denial of an I-539 in 2002. Does that fall under immigration proceedings?

    I got married a couple of weeks ago and my wife is a US citizen.

    She is filing an I-130 on my behalf. In the "question 16" should she put yes? If yes, which one? or no? should she attach a letter explaining this?

    Any help would be greatly appreciated.

    as far as i understand it, immigration proceedings means that immigration actually asked you to leave the US or started a deportation process against you.

    if the denial of an I-539 form did not follow a request for you to leave the US
    than you should pot NO as your answer.

    just being here illegally does not fall under this category.
