My question involves paternity law for the State of: Florida
I am married but have been having an affair/relationship on the side for 3+ years. I just gave birth to my son, and birth certificate has my husbands name on it. My lover agreed to an at home collection DNA test after birth, which came back showing he is the biological father. My husband does not know at this point.
My question is, since I am thinking about leaving my husband, does he have any legal ties to my son when it all comes down. Would he be able to get partial custody when he is not the biological father, because he is listed on the birth certificate? And is there a way to not ask for child support during a divorce hearing? I am not looking for any $$ from my husband. I am just wanting to make sure he cannot have custody.
