    Default Is Giving Notice Considered Terminating a Contract

    I don't get my deposit back if I terminate my contract before the 1st of January 2010.

    There is one month notice in the apartment I'm renting. If I were to give notice before January would I get my deposit back? Is giving the 1-month notice consiedered terminating my contract?

    Laws are different in each state, and your rights may depend upon the terms of your lease.

    If you are stating that your lease ends on January 1, 2010, and you're wondering if you can give notice in advance that you're going to move out as of January 1, 2010, yes, you can.
