    Default How Far Back Can I Get Credited for Incorrect Charges

    My question involves business law in the state of: California.

    A vendor of ours has been over charging us on the cylinders we rent to contain the gases we buy from them. We recently discovered they have been charging us for more cylinders and for longer durations than that was actually in our inventory. This was verified by comparing the quantities in the rental bills vs. the gas bills as they are separate. The vendor already gave us back credit for overcharges for the past year, but my question is if they are required to credit us back even further? Thanks much.

    They can give you credit, or you can sue them back to the start of the statute of limitations which is likely five years or whatever CA has for contracts. However, you should talk to an attorney.

    You can probably go back four years under the statute of limitations governing written contracts. Try negotiating and, if that fails, consider whether the money involved justifies taking additional steps (e.g., a letter from your lawyer; litigation) to try to recover the overcharged amounts.
