    Default Proving Innocence of Grand Theft Auto Charges

    My boyfriend likes to "test" his limits as well as his cars limits..last year in april he got into a pretty serious accident..he was goin 130 on the high way someone clipped his back bumper and sent him flying out of control hitting another car and into a construction site ending by him hitting into a concrete block. He got out without a scratch or a brusie (he's lucky to be alive). Now the problem is it wasn't his car..it was a clients car, but the client was a friend of his. He asked him if he could borrow it and the client said yes..but now the client found out that he can't get insurance to pay for it since he wasn't the driver. My boyfriend is now being charged with grand theft auto and reckless driving (which im 99.9% sure hes gonna get charged with since hes had his license taken away bout 5 times now) How can he prove that he did not steal the car..what steps are there to follow..and if he does get charged for it how much jail time can he get?

    Your boyfiend (sic) needs to get legal counsel.

    What evidence does he have that he didn't steal the car? Any witnesses to the borrowing? When was the car reported stolen, relative to the accident?

    Well his dad was there when my boyfriend and the client made the agreement..but it's his father. The accident happened on april 1st and when the cops came to the scene, peter told them that it wasn't his car and that he had borrowed it when the cops called his father he said that that infact was true and gave the cops the number of the car owner. though i don't know if the cop knows that it was borrowed and not stolen...so i guess he has to find the cop who did all the calling?? and how can we find him.

    Good luck on that one... but the arrest report may have names.

    It's possible that incoming phone records may exist for your BFs father. Check into that immediately. Have your BF speak with his attorney about his father's role during the borrowing of the vehicle. The atty may want an affidavit. Of course the wildcard here is the vehicle owner.
