    Default MIC in Texas

    On Saturday I attended a party with a few friends, and as the night went on it got bigger. Well it was to loud and the cops were called, and the party was busted. The cops came in and asked for anyone underage who was drinking. I and another guy raised our hands and the cops ran out IDs. I was not breath tested in any way hardly was even spoke to (Maybe because there was at least 15 others waiting also) then they gave me a citation for "Consumption of Alcohol by a minor" and was told I could leave. I have a court date the 30th, and wondering what could happen. A fine? Community service? and because I was not breath tested could I use this to lower my Citation I received. Thanks for any feed back.

    P.S I'm 20 years old, Don't know if this can add to anything, also This is my first offense.

    The offense is a Class C misdemeanor, carrying a possible jail sentence (unlikely), fines, community service, and driver's license suspension. You may be able to get a deferral; I suggest talking to a lawyer if you wish to try to take the charge to trial, and to see if you might be able to obtain a better outcome.

    I also have a question, I'm fifteen and I just got an MIC a couple nights ago and I haven't gone to court yet, and I haven't seen a lawyer yet.

    I don't know if I should plead guilty or no contest, this is my first offense, ever, and I have no experience whatsoever as to what I should do.

    I've been trying to do some research online for the differences between no contest and guilty. I've been leaning towards no contest, because my friend who was with me at the time and who also received an MIC told me that was the course she was going to take, but I know that I consumed alcohol and from my research I discovered that pleading guilty would just be like giving up and flat out saying "I did it" and I plan on telling the absolute truth to every question anyone asks me because I do not want to get in any more trouble then I already am, and pleading no contest would be like not saying you did do it but not saying you didn't, and you don't want to fight, or something along those lines, and my deal with that is that I don't want to fight it I don't want them to have to show evidence or do anything, just charge me and get it over and done with.

    Can you please explain the differences in a simple way, and which course I should take? I'm so lost and I don't know what else to do. Also, if I plead either, would the consequences be the same? What would happen afterward? Would there be a trial and would they show evidence?Thank you so much.
