    Default last name change

    My son is almost 5, and his biological father has not seen him in 3 years, has been in jail, and is just sorry, Unfortunaltly my son has his last name and I am trying to get it changed back to mine. I saw an attorney and she said the only way is if he signs over his rights? Is there anything else I can do?
