    Thumbs down Assault

    My question involves criminal law for the state of: Nebraska

    So im 17 and i was at my friends house and this guy was drunk trying to start a fight ik he tryed to swing at me hes twice my size and i was playing pool and i hit him with a pool stick and broke it over him and his ear was split in half then i started hitting him in the stomach after i seen the damage i was ganna take him to the hospital but he was so drunk hes only 18 i didnt wanna get him any drunk charges or anything so we cleand him up he took a shower in the morning and then we took him there he had a claspe lung and he went got transfer to a bigger hospital but hes out he didnt say anything but i guess the cheif is ahead of the case and trying to get me with the highest amout of assault.

    well, depending on what was happening when you decided to hit him and if he was still a threat after you whacked him with the cue, you may or may not have a serious problem on your hands.

    If the police are looking into charges, I would suggest that somebody at the party said it was not self defense.

    hitting a person that has hit you or assaulted you is permissible. Hitting a guy because he might hit you isn't.

    Continuing to beat on him after he is no longer a threat of threatening you is not self defense.

    not condemning or saying that is how it went, just trying to explain.

    he wasnt really a threat cuz he fell down ik i should of stoped but i just got pissed off when he swingd at me

    you are in some serious trouble Tim. Assault with a deadly weapon comes to mind. I haven't really looked into specific crimes you can be charged with but I am sure there are more. You REALLY need an attorney NOW. Do not say anything more to the police and get an attorney.

    from your pm (which included just a bit more info), witnesses are going to either have to support or condemn you. While you may believe they will not say anything against you, what they don't say (as in supporting your position) is just as important. I would strongly caution anybody against outright lying to the investigators as well. That always causes problems because then nobody even has the same story PLUS that can cause them to be charged with a crime as well.

    get an attorney, NOW.
