    Default Do I Need a Lawyer for Shoplifting?

    hello,

    5 years ago, i was convicted for credit card fraud which is not my fault... i was very new in US and met agirl from my country and trusted her so much that if we go shopping, she will asked me check out and pay for the stuff she's buying making excuses that she wants to look for more... i was so naive and have no idea about US law, i did everything she said 'coz for me she's my friend... after a month or two, we were caught but the girl already flew back to our country even before the police arrested us so i was left alone to face everything... went to jail for three months and was under probabtion for five years... last december 2005 was my last month for probation... yesterday, i was caught shoplifitng but i don't intend to do it... i am planning to return it 'coz i just used my self as a guinea pig to conduct my investigation about security in stores... almost two weeks ago, i saw a show that dicussed about how shopping stores are not even looking at the signature and ID of buyers using credit card that even a black man was able to use a white man's card... i planned to check it my self but so stupid to do it myself... am i gonna be in trouble for this and go back to jail ??? the stuff that i took was on 90% clearance... they just me questions and let me go but told me that they will send a restitution letter for me to pay for a fine... what's next ??? are they gonna arrest me eventually ???

    Your first round of credit card fraud was "somebody else's fault" because you didn't realize that it was illegal in the United States to use a stolen credit card? Your second round of credit card fraud was a "test" of store security? Give me a break.

    You're here on a visa? If so you could, of course, end up being deported.

    the second offense was not a credit card fraud... it was shoplifting for earrings that are on 90% clearance... i am not gonna put my self into such burden again of going to jail for fake earrings that are $2 each... i just wanted to know if i need to go to the court for this... thanks...

    oh, and more thing, when i was using the credit cards, i am not even aware they are stolen... she told me the cards she was using was her aunt's or cousin's... that might be stupidity on my part but being here in US for only two months coming from a country where credit cards are only for movie stars, politicians and rich people, i don't have a single clue to tell you the truth...

    What does stealing earrings have to do with "testing" a store's ability to detect if you are using a stolen credit card?

    If you are prosecuted you will have to go to court. Maybe you'll be lucky.

    mr. knowitall,

    for someone who's claiming he knows everything, you're lacking the comprehension ability... i did not steal those earrings to test their credit card security system... i am testing the ENTIRE loss prevention system... the show about the credit card is just a trigger for me to investigate... i was for one, a victim of identity theft, i have a firsthand experience of getting convicted for credit card fraud, so seeing this show made me wander what kind of security are these stores using and what are their protocols...

    you know, i went to this site hoping i can get an answer but instead, i got judgemental comments from saint people just because i am not perfect !!! i am so sorry for invading your pure site... it's just so pathetic how you treat us like mediocre or your everyday clown... just like ms. crudeness who asked for some information but instead, she got sarcasms from you... this site is suppose to help "knownothing" people to get their answers and for all of you "knowitall" to enlighten us...

    i will get more sarcasms anyway because you don't want to look like a loser for not responding at all so go ahead, budge in !!! this will be my last visit on this site anyway for i didn't get any information here at all but just blabbing from someone who thinks highly of himself !!! NOW YOUR TURN !!!

    I was relying upon your words. It is not my fault that your fables about your reasons for stealing are inconsistent and unpersuasive.
