    Default Roomate Just Up and Left No Notice No Money

    My question involves a roommate in the State of: FL

    My name is Scott i live in Tampa Florida

    September 27th. My roomate proceeds to knock on door at 9am to use my cell phone( His is disconnected). I wake up not happy that i had been woken up at 9 on my day off. I give him my phone and tell him to pay his phone bill and close my door. He knew i was unhappy but didnt seem to care because....

    October 1st- Roomate again knocks on my door for the same thing. I get very agitated (i work 55 hours a week with 2 days off so i work alot of 12 hour shifts). This time i was not as easy going as i was the previous time. I was honest but firm about his financial situation. He begins to blame my dog among others things why he cant pay his bills. Part of this is true because my parents adopted me a dog and it turns out that my complex doesnt allow german shephards to live here i was forced to stay on a month to month lease extension which did raise my rent by $180. My 12 month ended in august so ive been living month to month for 2 months and planned to be out by the end of October.


    October 7th-8th- My roomate procceds to move out with no notice or no rent/utilities. I confront him about it and he tells me that he will give it to me before the night was over. (which of coarse didnt happen)


    Getting him to sign the moveout paper was not pleasant. I had to track him down at his job because i first had the complex call him a few times and he just kept lying telling them he was going to come by and sign it. which he never did. AND he wont tell me where hes staying and i needed him to sign the MOVEOUT notice so i can leave. When he saw me he started walking in the other direction. I had his manager go get him and i explained the situation to the manger.. . He scribbled a signiture on the paper. and i handed it in, This was done on OCTOBER 15. 15 days into the month. my apartment complex only requires a 15 day notice to move out. If i take him to court what can i expect as far as reimbursement since most places require 30 days.

    im out about $700

    well, since we have no idea as to what your actual situation is and what the two of your agreed upon, answering is a bit of a problem so;

    are you both on the lease?
    did the both of you agree to split the rent 50/50?
    including that $180 you caused the rent to be increased?
    whose name are the utilities in?
    did the two of you agree to split them 50/50 as well?

    i had the complex call him a few times and he just kept lying telling them he was going to come by and sign it.
    sign what?

    Sign the notice to vacate the apartment they wouldnt accept just my signiture they wanted both
    1) we are both on the lease

    3)yes my parents adopting me a dog delayed my resigning of a 12 month lease since they dont accept the type of breed i was stuck in limbo Rent increased 180/month because i was living month to month. I didnt want to resign a new 12 month w/o my dog. He was aware of the situation and i told him it would only be a temp situation i told him i was planning to be out by the end of october

    5)yes even though him being in his current financial situation i wouldnt ask him for the water/garbage bill. Electric and cable we payed 50/50

    He also punched a hole in the wall in his room which i have a picture of.

    what most places required is irrelevant. It is what this place requires that is involved.

    It appears you (both) gave notice the 15th so your lease ends the 30th (15 days notice). He would owe you 1/2 of the rent for that time and apparently 1/2 of the cable and electric for October.

    While the damage is most likely going to be taken from your deposit, since hecaused all of the damage, he should reimburse you for the 1/2 that you end up paying via the deposit retention.

    Seems fair. I don't think he will see it that way though. His intentions were to try to put me into a position like this and its eating away my money at an alarming rate and its just gonna get worse.

    i guess i can recalculate the rent/bills for 15 days and see if he will accept that. But since he has ignored my previous calls/messages about the money i dont see this being resolved which is why i posted here to try to figure out an alternative legally

    sue him in small claims court
