    Default Trespassing Charge After Shopping at a Store I Am Banned From

    My question is in the state of Oregon.

    I was banned from entering Nordstrom for 2 years for a retail theft incident. Last night I was at the mall shopping and went into Nordstrom - thinking that it had been 2 years since I was banned. I bought an item with my credit card and was only in the store for probably about 15 mins. I left the store with no problems. When I got home, I realized that I am just shy of 2 years, so technically I am still banned from the store. Now I am freaking out I am going to get arrested for trespassing since they have proof i was in the store, before the 2 years was up (the proof being my credit card transaction). Is it likely they will see the credit card transaction, see me in video surveillance in the store, call the police and have me arrested for coming in while still banned? I honestly wouldn't have gone in if I thought it was within the 2 years. HELP!!! I am freaking out!!!

    Were you arrested and issued a trespassing warning? Or, did they handle it internally and you signed an agreement not to enter the store for two years?

    THank you for the reply. If I do get in trouble for this would it be via letter, phone or cops knocking at my door? Do you think they would go easy on me since it was an honest mistake and almost 2 years? My husband says I'm getting worried and worked up for nothing. Is he right?

    Your husband is absolutely correct.

    Retailers process hundreds (and in some locations, thousands) of credit card transactions a day. They simply don't have time to check them all against any sort of "this person is banned" list every night, to make sure that you don't set foot in the store even a second sooner than when your ban expires, pull up video, then go bug the police because you came in a few days early.

    Relax. They're not coming for you. If you're going to keep panicking, you might just consider staying out of Nordstrom's forever, for your own peace of mind.

    Just out of curiosity, how does one get caught for trespassing, if not after the fact via video surveillance? Is it more likely a getting spotted by someone who knows you in the store sort of deal? Or is being trespessed by a store more of a scare tactic, just to have one not come in anymore out of fear of getting caught? I am just so scared - I do, however, appreciate all the advice - it has somewhat eased my fear and panic.
