My question involves child support in the State of: CO
I will try to keep this long story short. 2 of my 3 children are over 21, the age of emancipation in CO is 19 or one month after graduating high school. So the oldest 2 are emancipated. However I cannot get them off the current support order. I have been trying to modify the order since the oldest one turned 20. I cannot make it to Co (i live in another state and have NO MONEY, in a good pay period I get $300 from my paychecks(every 2 weeks), so travel to CO is not possible) (child support is taken out of pay checks so it is being paid every month) and have tried to appear by phone but no one will tell me how to do this (or if I can). Now I am trying to see if I can appear by phone from my local CSED office.
In the last attempt to modify the order the Motion I was sent stated the oldest 2 are emancipated and had a lower monthly support order. So to me that means the state acknowledges that the children are to old to be on the order (and there is no special circumstances that would extent support for those children).
Why do I have to be there for this modification go happen? I sent letters stating that I had no problem with the modification of the order and could not physically appear. But would call in (on my dime). I got no response. I called and wrote to everyone I could think of. I am trying to get a pro-bono lawyer but no luck yet. I would of hired one a long time ago but like I said I have barley enough money to feed myself and has gas to get to work.
Any advice on how to get a pro bono lawyer or do this myself would be great.
I would also like to know if I have a case (of Fraud) against my ex and/or the state CSED. because in our divorce decree it says both of us have to notify the state/court/and each other of changes that might change the support amount (also notify about moving and important stuff involving the children).
my ex has moved (stayed in the same city) a few different times and I found out months later from the children. my youngest has gone to jobcorp and I wasn't notified nor do I have a current address for that child.
In jobcorp don't you get paid? so he is not living at home and making his own money.
