My question involves divorce in the State of: Nebraska.

My husband was divorced from his first wife in 2003. The original divorce decree requires him to pay $600 or half of a $1200 attorney fee. At the time, he made a verbal agreement with his ex-wife that she would pay all of the fees. He was young and naive and did not get this in writing.

So six years later, the attorney is asking that we pay this $600 plus interest (at 3% = $115). On top of that, he is charging additional administrative fees to a grand total of about $1300. My husband is also being charged with contempt.

The plaintaff in the case is the ex-wife, even though the attorney representing her and bringing forth this suit says this was initiated by him. It was only a formality to have her as the plaintaff.

During conversations with this attorney, it came to light that the ex-wife has in fact paid the entire $1200 though we have not received proof of this or an itemization of the attorney's charges to date. We have tried to reach the ex-wife for some explanation from her, and she is not returning our calls.

Does this seem fishy to you? We feel like we're getting duped here but need to keep my husband's name clean (as he works in law enforcement). We recently were able to negotiate a deal for $1000 in complete and total payment and dismissal of the contempt case. Should we go forward with this deal or are we being taken advantage of?
