My question involves landlord-tenant law in the State of: Virginia
We have been renting from a military family, via a professional property managment firm, and a clause in our rental agreement gave them the right to terminate the lease if they were transferred back to the area. They gave us notice this week and informed us that they are moving back on December 18th. We'd like to vacate and find a new place to rent ASAP, but have been told that we are responsible for rent up until December 18th. We can't afford to pay for two places at once, but we also don't want to be moving the week before Christmas. Can they require that, or are we free to leave anytime between when they give us notice and when they intend to move back?
The relevant portion of the lease says:
"It is agreed that if the landlord is transferred back to the Washington area by the employer or the armed forces, the landlord shall have the right to terminate this lease by giving the tenant at least 60 days notice whereupon the tenant shall vacate and surrender possession of the premises to the landlord within the termination time period."
