    Default Speeding Ticket, Higher Bail Fee Than Expected

    My question involves a speeding ticket from the State of: California

    So I got a speeding ticket on 680 in Fremont. I was going 80 in a 55 zone. The officer was kind enough to lower it 70 so the bail fee would be lower. He mentioned it will be in the $100's. When I got the courtesy notice, bail fee with traffic school noted is $266!!

    So I reviewed the ticket he wrote and in the speed approx. box he put in 70 but in the violation description he wrote "actual speed 81+ mph"

    I feel I was duped, he said one thing but wrote down another.

    Has anyone else experienced this? Any success in lowering the assessed fee? Does the Speed Approx. box overrule the description. Can this be modified over the phone? There's a phone number for the Fremont court on the ticket.

    The $266 fine and if it includes the administrative fee for traffic school, is in fact the fine amount for 1 to 15 miles over the limit. That is from the Uniform Bail Schedule that sets the guideline for each and every California court. It doesn't get any lower than that.

    is the 2007 version the latest bail schedule? 1-15 over a 55 total bail is $146. is there a more up to date bail schedule, where can i find it? thanks.

    The 2009 UNIFORM BAIL AND PENALTY SCHEDULES - January 2009 Edition is the latest version.

    Do note the following:

    1. There is a footnote at the bottom of each page which adds a total of $55 to the total bail amount shown for each vehicle code section violation.

    2. Some courts are charging $30 instead of $20 for "court security" pursuant to a new bill passed by the legislature... which makes that amount I mentioned above $65... And

    3. Keep in mind that some courts charge $49 for traffic school while others charge $69.

    Not sure where your court stands on each of those differentials, but if you want an accurate accounting of your $266, you can contact the court.

    Thanks. Oh, looks like the fees are unchanged for the violation I have.

    22349 (b) I Speeding 1–15 MPH Over 55 MPH Limit, total bail = 146.00

    So it looks like the clerk went with the description instead of the Speed approx. box.

    22349 (b) I Speeding 16–25 MPH Over 55 MPH Limit, total bail = 266.00

    Anyone in a situation like this had luck getting the fee lowered? I will try to give the number a call later.

    Nope, the officer still did you a favor. The reason your fine and traffic school option are so high is because the fines and fees went up significantly as of 01/01/2009, and I heard they got bumped up again mid-2009. I got a ticket on 880 in july, and traffic school is $270 (i have 1 point on my lic).

    That's weird. Because even in the September 2009 edition of the bail and penalty schedule, 15mph over 55 is still set at $146.00. Does Fremont have its own schedule?
    Uff, past 4 now, too late to call them.
    There is night court tonight. Does traffic division night court at the Fremont Hall of Justice mean the traffic counter is open or is just for court hearings?

    Nothing weird about it... Read my last post and you'll see...

    On the bail schedule that you looked at, and just to the right of the 146.00, you'll see a "+"... Now scroll to the bottom of the page and you'll see that footnote which states: "+ A court security fee of $20 and a conviction assessment of $35 are charged in addition to the Total Bail for each offense."

    Keep in mind that the $20 Court Security fee went up to $30 from $20 in June (Here's a link to the Senate Bill authorizing that change MEASURE : S.B. No. 13 (4th Ex. Sess.)). So instead of adding $20+$35 (as per the footnote) you're adding $30+$35

    So...
    $146 Total Baill amount
    $65 (footnote)
    $49 Traffic School administrative fee
    $1 Night Court fee
    ======
    $261

    If you want to call the court to argue about the $5 difference then be my guest... I can tell you the difference will be due to the fact that the different counties are allowed to charge a different percentage amount for the "County Penalty Assessment" shown in the 3rd column (between "State" and "DNA").
