    Default Arrested for Shoplifting but Store Will Not Press Charges

    My question involves criminal law for the state of: Virginia

    My son was caught shopping at Food Lion. He stole a $4 bottle of cough medicine. The security people at the store are not pressing charges but he was arrested and is injail. He is being arraigned tomorrow. He is presently on a two year suspened sentence. I am worried that he will go to jail for two years. Will he go to jail if the charges against him are not pressed by the store?

    The store does not press charges. The DA does.

    If he is being arraigned tomorrow, he is going to have to hope that the DA is in a great mood.

    What was he originally sentenced to probation for?

    How was he arrested if charges were not pressed?

    They had to have been the complainant at the time or the police would never have arrested him.

    The store calls the police.

    The D.A. gets the charge, copies of video tape, signed confession, etc and decides to prosecute.

    Since he has the first charge, again....hope the DA is in a great mood. Suspended Sentence usually means - you are free now, keep out of trouble. Get in trouble, the sentence is no longer suspended and expect to spend time in jail.
