    Angry Making My Boyfriend Move Out

    My question involves a roommate in the State of: Colorado
    I have a boyfriend who has been staying in my home for 2 weeks now. He has moved in some personal items, but does not get mail at the address in question. He has an apartment of his own, but has been spending several over nights in my house. He has also moved in some furniture, which I helped pay for...I have done away with all the furniture I had. He does not pay bills, nor have we discussed the bills for the house. I have found out he has been cheating, and I want him out of the house ASAP. My concern is if I lock him out does he have any legal recourse; asking him to leave and stay gone is not an option because I do not think he will just go. I am also concerned because of the furniture in the home; while he went and got the furniture I did help pay for it...what can he do? Any help on this would be great.:

    He can sue you for the value of the furniture that he paid for if you keep it. If you can prove to the court that you paid for some of it, the court may credit you with the amount already paid and you'd then pay for the remaining amount. Or, the court could rule that you give HIM the furniture, and he reimburse you for any amount that you can prove you paid.

    Getting mail, in and of itself, doesn't establish or disestablish residency. If he's living somewhere ELSE where he's got his stuff, he'd be hard pressed to prove to a court that any locking out or eviction on your part was unlawful. So you ask him to go. Then you ask a COURT to issue a restraining order asking him to go and stay gone. Of course, he'd still be able to bring a valid lawsuit for the value of the furniture.
