    Question Utilities Resposibilities (Under Table Sublease)

    My question involves sublet-tenant law in the State of: Florida

    I (tenent) moved into a 5 bedroom house with 4 other guys. Only 1 guy on the lease contract, and 1 witness signature. I did not sign anything, my name is not on any bills and I never had to give a security deposit. I lived there under the table for 4 months. Myself and 3 other guys wanted to move out (and none of their names are on anything as well). The lease for this house ended in August. On August 2nd we texted the guy who's name is on the lease that we were probably moving out and payed rent for our last month in September (which we were only living there until September 15th). The guy who's name is on the lease wants to make us pay power, utilities and cable for the whole month, are we legally responsible to pay these bills if technically we never lived there? need help asap, he wants to take all three of us to court for $270, and he's getting everyone's security deposit a total of almost $1400. thanks

    This questions was asked before.

    First, he would need 30 days notice from you, as you, and the others, are a month to month subtenant", so you'll be liable for at least 30 days, or moveout, whichever is later.

    As to utility bills, I have gone on extended business trips, expected a ZERO bill, when I return, yet there is a balance due for the month I was gone, and I live alone. This is becuase the utiltity charge for having the account open, their expenses for bringing electricity to the house, even though no one is using it.

    In your case, obviously, the guy staying used some electric and gas, but all of the guys who left also owes the part for maintaining the account. If you guys don't mind counting pennies, the fairest way is to separate out the actual meter charges, and everyone evenly split the rest.

    counting pennies is the whole point! I'm really curious to know if he even has a case should he file a small claim in court.
