My question involves criminal law for the state of: Texas
On his way to work at 7am on May of this year my husband got pulled over for speeding, when the cop ran his license it came up suspended (which we didnt know because it was for payments not being made for a case that was dismissed) the cop was going to give him a ticket and get his car towed and when the tow truck guy came, they did the general search for valuables in the car and they found a joint. My husband then got arrested for possesion of Marijuana. He went to jail, and court and got put on probation for 6 months with mandatory drug tests, he passed his first 2 but failed the third. He now got his probation revoked and has a warrant out. We are very concerned because we cannot afford him to go to jail, he is the main provider for our family ( wife, child, mom, and dad)and if he would go to jail he would lose his job and we would be left on the street. His mom is currently undergoing chemo for breast cancer, and his dad is bed ridden, and he is who takes care of his every need. I was recently laid off from work and his income is the only thing that is saving us right now. He smokes due to stress but had stopped however after his father got sick he did it again and failed his drug test. He has a respectable job and has no record and no prior run ins with the law. What possible outcomes do we have here??
