    Default Rights of a Former House Guest in My State

    My question involves a roommate in the State of: Florida

    Short question is: temporary roommate who stayed longer than temporary, left my home voluntarily in a cab 33 days ago, and is now leaving messages on my phone saying he'll be homeless soon. Does he have any rights to live in my house again?

    I know that may sound like a strange question, but I also know that once a guest stays one night, if they refuse to leave, you must evict them, and I'm looking to see if there are anymore seemingly unreasonable laws that would apply.

    Longer story involves calling 911, dom.battery, no-contact order and temporary injunction. Will give more details if needed.

    You can ask your guests to leave. If they don't, they're trespassers.

    Even if we read between the lines, such that this is a boyfriend who "moved in with you" before a nasty break-up, the guy moved out of his own accord 33 days ago. You don't owe him a home.

    I wanted confirmation that since he moved out on his own, he has no way back in -- according to law.

    See, when you say just ask them to leave, and they don't, if they'd stayed just one night, according to Florida law, the police cannot do anything for you unless you have the proper eviction paper. Or so I'm told by someone at the State offices, and other sources.

    Yes, well, it was a nasty night, though not a breakup. I now consider us done, but he doesn't seem to think so. I could not contact him without risking jail time, now that case is dropped, but the injunction is against him, and I am advised to not talk to him. He's breaking the injunction by calling and leaving many messages, he is in contempt. He seems to think that this is still his home.

    Well, I just wanted to see if anyone here knew anything concrete.
