    Default Public Intoxication in Myrtle Beach

    My question involves criminal law for the state of: South Carolina, Myrtle Beach

    I was arrested for munci code Sec. 14-66. Public intoxication or impairment.
    Jury trial in two weeks
    I need help not referrals, unless it is pro-bono

    I went swimming about 3-4 in the morning in the ocean, to swim to a buoy and back because I wasn’t allowed to do so during lifeguard hours as there is a waist deep policy, after 11pm there it is swim at your own risk. On my way into the water my friends didn’t see me surface from the room and panicked went to see if I did or didn’t. Hotel security came to see the problem and called the local authorities. I saw the lights of them searching from the buoy and swam back to shore, to prevent a coast guard search. I walked out of the water waving my hands that I was fine. The officers asked my friends if I had been drinking that night, because he/they smelled alcohol on my breath, they said yes. I was placed under arrest and later booked. I requested a jury trial, because I thought that the distance that I swam would be proof enough that I was not intoxicated.

    Other information
    *Jury roster has already been held
    *no available monies to hire attorney
    *no incident report taken, not required by the state
    *Plea agreement offered is time served
    *called parasailing company for distance of buoy, is about 400-500 yds off shore
    Means a total of distance swam was about 800-1000 yds
    *friends willing to testify that I was not intoxicated
    My questions are
    *Should I contest or accept the plea?
    If I do contest,
    *I asked for a public atty but they said that P.D. isn’t available for that kind of charge is this true, what about my right to legal counsel?
    *How do I file motions like motion of discovery, or is too late?
    *Where can I get more information on how to defend against this charge?
    *How do I call witnesses?

    You ask, "Should I contest or accept the plea?" - what's being offered?

    I would expect that you aren't eligible for a lawyer because you aren't subject to the possibility of jail time for your offense if convicted.

    Disclosure is governed by Rule 5 of the South Carolina Rules of Criminal Procedure. Review also the other court rules and statutes.

    I have an addional question of what is the most likely sentence if found guilty for this charge?
