    Default Can I Be Sued After Being Robbed

    My question involves court procedures for the state of: MICHIGAN

    I WAS SELLING A DIAMOND RING VALUED AT $5500.00 FOR AN UNEMPLOYED FRIEND ON CRAIGSLIST UPON MEETING THE POTENTIAL BUYER HE ROBBED ME AND TOOK THE RING SHE NOW WANTS TO SUE ME CAN SHE? IN CASE YOU NEED TO KNOW I WAS NOT MAKING ANY MONEY OFF OF THIS JUST TRYING TO HELP A DOWN AND OUT FRIEND

    the police said i did everything right by meeting in a public place etc...

    Please don't type in all caps. It's difficult to read, and is the equivalent of shouting.

    One presumes you filed a police report immediately after the robbery?

    She can certainly sue. Whether or not she would prevail, however, is a different story entirely. The court would look at the facts of the case - including how quickly you reported the robbery to the authorities, if you did so at all - and proceed from there.

    If she files suit, hire an attorney. Right now, she's mad and blustering, and there's nothing for you to do but wait to see what she will do.

    the first thing i did was call the police then i even contacted my insurance company as i felt so bad about the situation ( sorry about the caps) i did not even scream i just dialed 911 she on the other hand took days to even contact her insurance

    You seem to have covered home plate here.

    LIABILITY in a civil suit is generally based on some type of negligence theory!

    Was your acts the "proximate/direct cause" of you being robbed??? I would say NO.

    If you arranged a meeting in a not so public manner, the door may be ajar somewhat??

    You, of course, had a "duty of care" to safeguard her possession, and it appears you were reasonable in doing so. One is not required to hire an off duty policeman to accompany them to a Jewel sale.

    If she sues, she will have to provide some direct case law to the court on WHY you are liable.

    Thanks for the advice Also several newspapers and even a news station ran the story and they all said i did the right thing by meeting in public. Just nervous as she was a friend and now i keep getting threatening emails from her!

    Just tell her you do not believe you are liable, and in anticipation of a suit, tell her to have a sound legal theory if she wishes to prevail.

    She just can't file a suit with a Cause of action that has no merit.
