    Default Accused of Shoplifting: Will They Show Tapes in Court

    My question involves criminal law for the state of: Pennsylvania

    A few weeks ago, I was in J.C. Penny shopping with my friend. We had a $100 giftcard so we decided to buy some jewelry. Long story short, I walked out of the store with two bracelets that we hadn't paid for. I'm sure many won't believe me, but to be honest, it was the result of a huge brain fart and I just didn't remember that I had them still. I know, unlikely. Anyways, I was wondering if they're going to show the tapes in court, or what else I can be prepared for. I'm pleading not guilty, but I know the chances of getting off are basically 0% because in all likelihood the tapes will make it seem as if I did it on purpose. I mean... I DID put the bracelet in my pocket/on my wrist, I just don't remember doing it.

    There is no way we can predict what Penney's will or will not do.

    Well obviously, I meant what is the normal etiquette for these types of things?

    The answer does not change.

    Some retailers will show tapes, some won't. We can't tell you what Penney's will do.

    If they have tapes of it, AND they are going to use the tapes as evidence, the commonwealth attorney is required to show them to you/your attorney.

    All evidence they are going to use against can be requested via a subpoena duces tecum...(plain english - discovery).

    Yea that is a bitch. You pretty much don't need video tapes if they have those.

    But you can get around that if you have an experienced attorney. Key word(s) - experienced attorney. (Not a public defender who could care less about your case).
