    Default Was Passenger and "Did Operate Vehicle"

    My question involves a seatbelt ticket in the state of: WA

    I am trying to understand if I can beat this ticket based on contradiction in the infraction notice....

    The officer has correctly checked that I was a passenger. However, the officer has also filled in the vehicle details below the statement "did operate the following vehicle/motor vehicle on a public highway".

    Obviously, if I was a passenger, I did not operate the vehicle when I "did then and there commit each of the following offenses".

    get an affidavit from the Operator, who no doubt recieved some other ticket as i can't imagine they pulled the Operator over for a unbelted passenger

    get the ticket changed to unbelted passenger, which is in my locale a Civil issue

    and don't pay it ...

    if you have the nerve ..

    then try to get the officer prosecuted for Perjury

    of course, this won't happen in an Administrative Court, which is Your venue
