    Default Eviction Issues, Whos Responsible

    Long story short. I live with my GF and we got evicted from our Apt. I signed the first lease but when it came time to renew the lease I never resigned the paper work. She went down to the office as a Co -Tennant or co-signer cause she was just living there and signed it. After we got evicted, we moved out ASAP before the 7 days or what ever.

    Who gets marked with the eviction, if A. I never signed it, and B. she was never the main person responsible for the lease.

    If you did not sign the renewal lease, your lease continued as a month to month lease, with the same terms as the initial lease.

    If your girlfriend was not an original signer, she should not have been permitted to sign the renewal.

    The eviction may show up on both of your record, or it may show up only on yours. Who was named in the eviction action? Check with your county Clerk of Courts if you're still unsure.

    Missy is right. The landlord should not have let her sign if she was not on the original lease agreement as a tenant.

    if you were served the proper paperwork (eviction notice), your name or both would be listed on it - though I don't see how they could have her name listed legally.

    And when you say you got out before the 7 days, what do you mean?

    If they gave you a Pay or Quit and you paid and vacated before the eviction went to court, neither one of you would have it on your record.

    Please clarify.
